Privacy Policy and Data Processing Terms – VPlans Ltd

VPlans Ltd (hereinafter: the “Company” or “we”) provides a SaaS platform for real estate project management, quality assurance, and tenant relationship management (the “Platform”). This policy outlines how we process information within the Platform.
1. Roles of the Parties (Data Controller vs. Data Processor)
The Customer (Real Estate Company): Acts as the “Data Controller” and bears sole responsibility for the lawful collection of data, database registration, and obtaining all legally required consents from tenants and employees.
VPlans: Acts as a “Data Holder” and “Data Processor” on behalf of the Customer. The Company processes data solely for the purpose of providing the services and in accordance with the Customer’s instructions.
2. Types of Processed Data
As part of using the Platform, the following data may be processed (as provided by the Customer):
Identification and Contact Details: Full name, identification number (if provided), address, and contact details.
Financial and Contractual Information: Tenant account status, payment history, balances, guarantees, and legal agreements.
Engineering and Operational Information: Drawings, apartment plans, specifications, meeting summaries, and task management data.
Event and Location Data: Images and general location data linked to a specific reported event (e.g., defect reports from the field), where collected via the user’s device.
Audio Records and Transcriptions: Call recordings and their automated transcriptions for documentation and control purposes.
Technical Usage Data: IP addresses, device identifiers, activity logs, and cookies.
3. Purpose of Processing and Use of Anonymous Data
Provision of engineering, financial, and operational management services for real estate projects.
The Company may use aggregated and anonymized data (that does not enable personal identification) to improve Platform performance, conduct statistical analysis, and perform market research.
4. Tenant Portal and Disclaimer
The portal displays data managed by the Customer. The information presented does not constitute legal, accounting, or financial advice and does not replace verification against the Customer’s source systems.
VPlans is not responsible for the accuracy of data entered by the Customer. Responsibility for managing access permissions lies with the Customer; the Company shall not be liable for damages resulting from misconfigured permissions or unauthorized use.
5. Call Recordings and Transcriptions
The Customer bears sole responsibility for providing lawful notice (“this call is being recorded”) and obtaining consent in accordance with applicable laws, including wiretapping regulations.
6. Security, Resilience, and Data Location
Security: Technical and organizational security measures are implemented in accordance with the Israeli Privacy Protection Regulations (Data Security), 2017.
Data Location: Data is stored on cloud servers (e.g., AWS/Azure) in Israel, Europe, or the United States, subject to lawful transfer mechanisms such as SCCs or the Data Privacy Framework.
Termination: Upon contract termination, the Customer may export its data within [30] days. Thereafter, VPlans may delete the data, except where retention is required by law.
7. Sub-processors
VPlans uses external service providers (e.g., cloud services, messaging services, AI transcription). The Company ensures that such providers adhere to appropriate data protection and security standards.
8. Data Subject Rights
Requests to exercise rights of access or correction shall be handled by the Customer (real estate company). VPlans does not maintain direct contact with the Customer’s tenants.
Technical assistance from VPlans to extract data upon Customer request may be subject to additional fees. For inquiries: privacy@vplans.com.
9. Indemnification
Without derogating from the Terms of Use, the Customer shall indemnify and compensate VPlans for any damage or third-party claims arising from the Customer’s breach of obligations under privacy protection or wiretapping laws.
